Comments / suggestions of the stakeholders on DRAFT ofthe IRDAI (Registration and Operations of Branch Offices of ForeignReinsurers) Regulations, 2020;

1. प्राधिकरणनेनिम्नलिखितविनियमअधिसूचित कियेथे:

TheAuthority had notified following regulations:

क. आईआरडीएआई(लायड्स केसिवाय विदेशीपुनर्बीमाकर्ताओंके शाखाकार्यालयोंका पंजीकरण औरपरिचालन)विनियम, 2015 (इसकेबाद एफआरबीविनियम के रूपमें उल्लिखित) और

a.  IRDAI(Registration and Operations of Branch Offices of Foreign Reinsurers other thanLloyd’s) Regulations, 2015 (herein after referred as FRB regulations) and

ख.आईआरडीएआई(लायड्सइण्डिया) विनियम, 2016

b.  IRDAI(Lloyd’s India) Regulations, 2016.

2. उपरोक्तविनियमों केपुनरावलोकनकी पृष्ठभूमि:

Background for revisiting above regulations:

क. एफआरबीविनियमों केकुछ प्रावधान, वर्ष2015, 2016 और 2018 मेंसंशोधित हुएथे;

a.  Certain provisions of FRB Regulations got amended in year2015, 2016 and 2018;

ख. एफआरबीयोंके लिएव्यापार करनेमें सुविधा (ईओबीडी) सेसंबंधितमुद्दों कीजाँच करने केलिए सक्षमप्राधिकारीने एक समितिका गठन कियाथा। समिति नेइस मामले मेंअनुशंसाएँ कीहैं। जाँचकरने उपरान्तसंशोधितप्रारूपविनियमों केसंबंध में कुछअनुशंसाओं को स्वीकारकिया गयाहै;

b.  The Competent Authority had constituted a Committeeto examine the issues related to Ease of Doing Business (EoDB) for theFRBs.  The Committee has made recommendations on thematter.  Upon examination certain recommendations are considered inrevised draft regulations;

ग. वर्तमानमें विदेशीपुनर्बीमाकर्ता(एफआरबी) औरलायड्सइण्डिया केशाखाकार्यालयभिन्नविनियमों केआधार पर शासितहैं। यह पायागया था किएफआरबी के लिएलागू परिचालनसंबंधी अधिकतरप्रावधानलायड~सइण्डिया केप्रावधानजैसे हैं। इस प्रकारयह प्रस्तावितकिया गया है किइन विनियमोंके एकल विनियमके अंतर्गतसमेकित और एकीकृतकिया जायक्योंकि इससेदृष्टिकोण औरप्रभावीपर्यवेक्षणऔर निगरानीमें सुसंगतिरहेगी।

c.  At present Branch Office of Foreign Re-insurer (FRB)and Lloyd’s India are governed on the basis of differentregulations.  It was observed that majority of operations relatedprovisions applicable for FRBs are Lloyd’s India are same.  Thus, itis proposed to consolidate and converge these regulations under singleregulation as it will have consistency in approach and effective supervisionand monitoring.

3. उपरोक्त केमद्देनजरदोनोंविनियमों कोसमेकित करते हुएवर्तमानविनियमों कापुनरावलोकनकरना आवश्यकथा। उपरोक्तविनियमों काप्रारूप संलग्नहै।

In view ofthe above, it was necessary to revisit the existing regulations byconsolidating both the regulations.  The draft of captionedregulations is attached.
