Re: Timelinesfor submission of Life operational returns in BAP

जीवनबीमाकर्ताओंको मासिक,तिमाही औरवार्षिक रूपसे विभिन्नविवरणियाँप्रस्तुत करनाअनिवार्यकिया गया है। मासिकविवरणियाँ,जबकि बीएपीमाड्यूल केमाध्यम से औरमैन्युअली भीप्रस्तुत कीजा रही हैं,तिमाही ववार्षिकविवरणियाँ 2018-2019से, केवलबीएपी मॉड्यूलके माध्यम सेप्रस्तुत कीजा रही हैं।

Life Insurers have been mandated to submitvarious returns- monthly, quarterly and annually. While monthly returns arebeing submitted through BAP module and also manually, the quarterly and annualreturns are being submitted only through BAP module since 2018-2019.

प्राधिकरणने यह पाया हैकि कुछबीमाकर्ता, विवरणियाँनिर्धारितसमय-सीमा केभीतरप्रस्तुतनहीं कर रहेहैं और कुछबीमाकर्ताबार-बार, पहलेसे प्रस्तुतविवरणियोंमें बदलाव काअनुरोध करतेहैं और उनमेंसंशोधन करतेहैं। इससेप्राधिकरणद्वाराविनियामकसमीक्षा औरविश्लेषण कीप्रक्रियाबाधित होतीहै।

Authority observed that some Insurers are notsubmitting the returns within the timelines prescribed and some are frequentlyrequesting for unlocking of the already submitted returns to revise the same. This is hampering the regulatory review and analysis by the Authority

इसलिएबीएपी केमाध्यम सेपरिचालन-विवरणियाँप्रस्तुत करनेकी प्रक्रियाको कारगरबनाने के लिएनिम्नलिखितअनुदेश दियेजा रहे हैं।

Hence the following instructions are beingissued to streamline the process of submission of life operational returnsthrough BAP.

क) समय-सीमाएँ / Timelines:

i)  मासिकविवरणियाँ:आगामी माह की8वीं तिथि।

Monthlyreturns: 8^thof following month.

ii)  अन्यसभीविवरणियों कीसमय सीमानिम्न प्रकार,अपरिवर्तितरहती है:

iii)  Thetimelines for all other returns remain unchanged, as follows:

(1) अलेखापरीक्षिततिमाहीविवरणियाँ:तिमाही केअन्त से 30 वें दिन।

Unauditedquarterly returns: 30^th day from the end of the quarter.

(2) लेखापरीक्षितवार्षिकविवरणियाँ : 30जून।

AuditedAnnual Returns: 30^th June.

(3) वार्षिकआउटसोर्सिंगविवरणियाँ: 15मई।

YearlyOutsourcing Return: 15^th May.

(4) अन्यवार्षिकविवरणियाँ: 30जून।

OtherYearly Returns: 30^th June.

ख)   सभीजीवनबीमाकर्ताओंको इसकेद्वारा निर्देशदिया जाता हैकि वे उपरोक्तसमय-सीमा कापालन करें औरतदनुसार जीवनपरिचालन-विवरणियोंकी प्रस्तुतिसुनिश्चितकरें।

All LifeInsurers are hereby directed to adhere to the above timelines and ensuresubmission of life operational returns accordingly.

ग)    बीएपीमाड्यूल मेंयह प्रावधानकिया गया है ताकिबीमाकर्ता,प्राधिकरण को इसकाउल्लेख किए बिनाविवरणियोंमें उनकीप्रस्तुति कीतिथि से उनकेदेय होने की तिथितक 3 बार परिवर्तनकर सकते हैं। बीमाकर्ताविवरणियाँमें खोजी गयीकिसी भीत्रुटि मेंसुधार के लिए इसअवसर का इस्तेमालकर सकते हैंऔर संशोधितविवरणियाँपुन:अपलोड करसकते हैं। त्रुटिसुधार(अनलाकिंग) काविकल्प केवलमुख्यअनुपालनअधिकारी के लिएउपलब्ध करायागया है।

A provisionis made in the BAP Module to enable Insurers to unlock returns up to 3 timeswithout reference to the Authority, from the date of submission till the duedate.Insurers can utilize this opportunity to rectify any errors detected in thereturns and re-upload the revised returns. This option of unlocking isprovided only for the Chief Compliance Officer.

घ)    त्रुटिसुधारके ये तीनअवसर या विवरणियोंकी प्रस्तुतिकी देय तिथि, जोभी पहलेसमाप्त होजाते हैं तोबीमाकर्ता केलिएत्रुटिसुधारकी सुविधा अनुपलब्धकर दी जाएगी।

Once all the3 unlocking attempts or due date of submission of the returns, whichever isearlier, elapses, the unlocking facility will be disabled to the Insurer.

ङ)     त्रुटिपूर्णविवरणियों कीप्रस्तुतियाविवरणियों कीप्रस्तुतिमें विलंबहोने पर, बीमाअधिनियम केप्रासंगिकप्रावधानों,विनियमों औरदिशा-निर्देशोंया परिपत्रोंके अन्तर्गत, विनियामककार्यवाही कीजा सकती है।

Delayedsubmission of returns or submission of inaccurate returns is liable forregulatory action under the relevant provisions of the Insurance Act,Regulations and Guidelines or Circulars.

च)    येअनुदेश, जून 2020से, संबंधितअवधि के लिएविवरणियाँफाइल करने केलिए, प्रभावीहोंगे।

These instructionsshall come into force for the returns to be filed for the period pertaining toJune 2020 onwards.
