संदर्भ / Ref:

(i) आईआरडीएआई(साधारणबीमा व्यवसायकी आस्तियाँ, देयताएँऔर शोधक्षमतामार्जिन) विनियम, 2016; तथा

IRDAI (Assets,Liabilities, and Solvency Margin of General Insurance Business) Regulations,2016; and

(ii) आईआरडीए(बीमाकंपनियों केवित्तीयविवरण और लेखा-परीक्षककी रिपोर्टतैयार करना) विनियम, 2002

IRDA (Preparation ofFinancial Statements and Auditor’s Report of Insurance Companies) Regulations,2002.

यहदेखा गया हैकि कुछबीमाकर्ताओंने कोटा शेयरपुनर्बीमासमझौते सहितविभिन्नरूपों मेंपूँजी कर्ज-भार(गियरिंग) समझौतेकिये हैं। इनसमझौतों कीशर्तों की जाँचकी गई है तथाप्राधिकरण कासुविचारितअभिमत है किइस प्रकार केपूँजीगत कर्ज-भार(गियरिंग) समझौतेवित्तीयव्यवस्थाओंके स्वरूप केहैं औरप्राथमिक रूपसे जोखिमअंतरणव्यवस्थाएँनहीं हैं। यहप्रतीत होताहै किबीमाकर्ताओंने येव्यवस्थाएँशोधक्षमतामार्जिन अनुपातको सुधारने केलिए अपनाईहैं।

It has been observed that someof the insurers have entered into Capital Gearing treaties in various formsincluding Quota Share Reinsurance Treaty. The terms of these treaties have beenexamined, and the Authority is of the considered view that such Capital Gearingtreaties are of the nature of financial arrangements and not primarily a risktransfer mechanism. It appears that insurers have adopted these arrangements inorder to improve the solvency margin ratio.

2. उपर्युक्तको देखते हुए, प्राधिकरणबीमाकर्ताओंको निम्नानुसारनिर्देश देताहैः

In view of theabove, the Authority hereby directs the insurers as under:

क. कोईभी बीमाकर्ताइस परिपत्र केनिर्गम की तारीखसे प्रभावीरूप में कोईनये पूँजीगतकर्ज-भार (गियरिंग) समझौतेनहीं करेगा; तथा

a. No insurer shallenter into any fresh Capital Gearing treaties effective from the date ofissuance of this Circular; and

ख. बीमाकर्ताजिनकी बहियोंमें इसपरिपत्र के निर्गमकी तारीख कीस्थिति केअनुसार ऐसेसमझौतेविद्यमान हैं, निम्नलिखितकदम उठाएँगेः

b. Insurers who arehaving such treaties on their books as on the date of issuance of this Circularshall take the following steps:

i. समझौतोंको चरणबद्धतरीके सेसमाप्त करनेके लिए बोर्डद्वाराअनुमोदित कार्ययोजना समय-सीमाओंके साथप्राधिकरण को 30 जून2020 कोया उसके पहलेप्रस्तुतकरें ताकिशोधक्षमता कीशर्तों काअनुपालन कियाजा सके।

कार्यकी योजना मेंपूँजी लगानेकी आवश्यकता कानिर्धारण एवंइन पूँजीगतकर्ज-भार (गियरिंग) समझौतोंके संभावितसमापन के कारणलगाने के लिएइस प्रकारअपेक्षितपूँजी के लिएनिधियों केस्रोत भी शामिलकिये जाएँगे।

i. SubmitBoard approved Action Plan to the Authority on or before 30th June, 2020 forphasing out the treaties along with timelines such that it complies with theSolvency Stipulations.

The plan of actionshall also include assessment of requirement of capital infusion and sources offunds for the capital infusion so required due to prospective closure of theseCapital Gearing treaties

ii. प्रत्यक्षबीमाकर्ता (अध्यर्पक) आईआरडीएआई(साधारणबीमा व्यवसायकी आस्तियाँ, देयताएँऔर शोधक्षमतामार्जिन) विनियम, 2016 केअनुसारअनर्जितप्रीमियमरिजर्वों, प्रीमियमकमीरिज़र्वों, बकायादावारिज़र्वों (आईबीएनआर/ आईबीएनईआरसहित) के लिएउपयुक्तआरक्षितनिधियों (रिज़र्वों) कानिर्माणकरेंगे। इसकेअतिरिक्त, इसप्रकार केसमझौतों कालेखांकन “रूपकी अपेक्षाविषय-वस्तु” (सबस्टैंसओवर फार्म) केसिद्धांत केआधार पर कियाजाना चाहिए, जैसाकि अक्तूबर 2012 मेंप्राधिकरणद्वारा जारीकिये गयेवित्तीयविवरण तैयारकरने संबंधीमास्टरपरिपत्र केपैरा 2.13 मेंनिर्धारितहै।

ii. The direct insurers(cedants) shall create appropriate reserves towards Unearned Premium Reserves,Premium Deficiency Reserves, Outstanding Claims Reserves (including IBNR/IBNER)in accordance with IRDAI (Assets, Liabilities and Solvency Margin of GeneralInsurance Business) Regulations, 2016. Further, such treaties have to beaccounted for, based on the principle of “Substance over Form”, as prescribedby para 2.13 of Master Circular on Preparation of Financial Statements issuedby the Authority in October 2012.

All insurers areadvised to take note of the above for compliance.
