All Insurers as definedunder Sec. 2 (9) of the Act, IFSC IIOs, Exempted Insurers;

विषयःआईआरडीएआई केपासपुनर्बीमाव्यवस्थाओंकी फाइलिंगसंबंधीदिशानिर्देश।

Re:Guidelines on filing of Re-insurance arrangements with the IRDAI.

1.       यहआईआरडीएआई(पुनर्बीमा)विनियम, 2018 केविनियम 3(3)(क)(ख)के संदर्भ मेंहै जिसकेअनुसारअधिनियम कीधारा 2(9) केअंतर्गतयथापरिभाषितबीमाकर्ताओँ,आईएफएससीआईआईओ,छूट-प्राप्तबीमाकर्ताओं(इनदिशानिर्देशोंके प्रयोजन केलिए इन दिशानिर्देशोंमें इसके बाद `बीमाकर्ता’ के रूप मेंउल्लिखित) कोचाहिए कि वेआगामी वित्तीयवर्ष के लिएअपनापुनर्बीमाकार्यक्रमउक्त वित्तीयवर्ष केप्रारंभ सेपैंतालीस (45)दिन पहलेप्रस्तुतकरें।

Thishas reference to the Reg. 3 (3) (A) (b) of the IRDAI (Re-insurance), Regulations,2018 as per which, the Insurers as defined under Sec. 2 (9) of the Act, IFSCIIOs, Exempted Insurers (hereinafter referred as ‘insurer’ for the purpose ofthese guidelines), have to submit its re-insurance Programme for theforthcoming financial year, forty-five (45) days before commencement of thefinancial year;

2.       उपर्युक्तविनियमों केउपबंधों केअनुसार प्रस्तुतीकरणोंके अतिरिक्त,बीमाकर्तानिम्नलिखितका अनुपालनकरेंगेः

In addition to submissions asper provisions of above mentioned regulations, the insurers shall comply withthe following;

क.               यहपुष्टि करनेके लिए कि,विशिष्टवित्तीय वर्षके लिए लागूपुनर्बीमासमझौता(समझौते) जोखिमअंतरण कीअपेक्षाओं कोपूरा करता है(करते हैं), कोईभी पुनर्बीमाव्यवस्था जोविशुद्ध जोखिमअंतरण, जैसेपूँजीअनुकूलन(गियरिंग)समझौता,वैकल्पिकजोखिम अंतरणसमाधान, वित्तीयपुनर्बीमा,गैर-पारंपरिकसंरचित पुनर्बीमासमाधान अथवाजो किसी अन्यशब्द अथवा नामसे कहलाए, सेयुक्त नहींहै, आईआरडीएआई कोसूचित करने कीआवश्यकता है;

to confirm that, thereinsurance treaty(ies) applicable for particular financial year meet the risktransfer requirements. Any re-insurance arrangement which do not have pure risktransfer such as Capital Gearing Treaty, Alternate Risk Transfer Solution,Financial Re-insurance, non-traditional structured re-insurance solution or anyother term or name called, need to be informed to the IRDAI;

ख.              यदिबीमाकर्ताएआरटी,गैर-पारंपरिकसंरचित समाधान,वित्तीयपुनर्बीमा कोअपनाना चाहताहै, तो वहआईआऱडीएआई(पुनर्बीमा)विनियम, 2018 के विनियम8 के उपबंधोंके अनुसारप्राधिकरण कापूर्व-अनुमोदनप्राप्तकरेगा;

in case theinsurer intends to adopt ART, non-traditional structured solutions, FinancialRe-insurance, then it shall take prior approval of the Authority, as perprovisions of Reg. 8 of the IRDAI (Re-insurance) Regulations, 2018;

ग.               इनदिशानिर्देशोंके पैरा 3(क) मेंविनिर्दिष्टरूप मेंबीमाकर्ताद्वारा कीजानेवाली किसीप्रस्तावितपुनर्बीमाव्यवस्था(विशुद्ध जोखिमअंतरण / पारंपरिकपुनर्बीमासंविदा कोछोड़कर अन्य) केबारे मेंप्रत्येकवर्ष 1 मार्चको अथवा उससेपहलेआईआरडीएआई कोसूचित कियाजाएगा;

to inform the IRDAI on orbefore 1st March of every year about any proposed re-insurance arrangement(other than pure risk transfer / traditional re-insurance contract) to beentered in to by the insurer as specified in para 3 (a) of this guidelines;

घ.                इसप्रकार केजोखिम अंतरणऔर उसकेअनुपालन के लिएप्रयुक्तकार्यपद्धतिकोविनिर्दिष्ट करतेहुए अग्रणीपुनर्बीमाकर्ता(ओं)से उचित पुष्टीकरणप्राप्त कियाजाएगा तथा वहजब भी माँगाजाएगा तबआईआरडीएआई कोप्रस्तुतकिया जाएगा;

to obtaindue confirmation from the lead reinsurer(s) specifying the methodology used forsuch risk transfer and its compliance and submit the same with the IRDAI whenevercalled for;

3.       हमयह दोहरातेहैं कि एआरटीकरारों के लिएलेखांकनव्यवहारआईआरडीएपरिपत्र सं.आईआरडीए/सीआईआर/एफएण्डए/053/दिसं.-04दिनांक 08दिसंबर 2004 केउपबंधों केअनुसार होगा।

We reiteratethat, the accounting treatment for the ART agreements shall be as per theprovisions of the IRDA Circular No. IRDA/CIR/F&A/053/DEC-04 dated 08thDecember, 2004;

4.       यहआईआरडीएअधिनियम, 1999 कीधारा 14 केअंतर्गत प्रदत्तशक्तियों काप्रयोग करतेहुए जारी कियाजाता है।

This is issued in exercise ofthe powers conferred under Sec. 14 of the IRDA Act, 1999.

येदिशानिर्देशतत्कालप्रभाव सेलागू होंगे।

These guidelines shall beapplicable with immediate effect.
