प्राधिकरणने संदर्भ सं.आईआरडीए/आरआई/जीडीएल/एसईजेड/269/12/2017दिनांक 21.12. 2017 केद्वाराअंतरराष्ट्रीयवित्तीय सेवाकेन्द्र,एसईजेड मेंबीमाकर्ताओंऔर पुनर्बीमाकर्ताओंके पंजीकरण औरपरिचालनों कीप्रक्रिया कोविनियमितकरने के लिएभारतीय बीमाविनियामक औरविकासप्राधिकरण(अंतरराष्ट्रीयवित्तीय सेवाकेन्द्र बीमाकार्यालयों(आईआईओ) कापंजीकरण औरपरिचालन) दिशानिर्देश,2017 (इनदिशानिर्देशोंमें इसके बाद `आईआरडीएआई(आईआईओ)दिशानिर्देश,2017’ केरूप मेंउल्लिखित)जारी किये थे।

The Authority vide Ref. No. IRDA/RI/GDL/SEZ/269/12/2017dated 21.12.2017 had issued Insurance Regulatory and Development Authority ofIndia {Registration and Operations of International Financial Service CentreInsurance Offices(IIO)} Guidelines, 2017 (herein after referred to as ‘IRDAI(IIO) Guidelines, 2017’) for regulating the process of registration andoperations of insurers and reinsurers in International Financial ServiceCentre, SEZ.

2. 2019 केवित्तअधिनियम (सं. 2)के द्वाराबीमा अधिनियम,1938 के संशोधन केअनुसरण मेंबीमा अधिनियमकी धारा 6 मेंएक नई उप-धारा (3)निम्नानुसारनिविष्ट कीजाती हैः

“कोईभी बीमाकर्ताविशेष आर्थिकजोन अधिनियम, 2005की धारा 18 की उपधारा (1) मेंउल्लिखित एकअंतरराष्ट्रीयवित्तीय सेवाकेन्द्र मेंस्थापित शाखाके माध्यम सेपुनर्बीमाव्यवसाय मेंलगी हुई एकविदेशी कंपनीहोते हुए, तबतक पंजीकृतनहीं कियाजाएगा जब तककि उसके पासएक हजार करोड़रुपये सेअन्यून निवलस्वाधिकृतनिधियाँ नहों।”

2. Pursuant to amendment of Insurance Act 1938 by theFinance Act (No.2) of 2019, a new sub section (3) is inserted in section 6 ofthe Insurance Act as under:

“No insurer, being a foreign company engaged inre-insurance business through a branch established in an InternationalFinancial Services Centre referred to in sub section (1) of section 18 of theSpecial Economic Zones Act, 2005, shall be registered unless it has net ownedfunds of not less than rupees one thousand crore.”

3.उपर्युक्तसंशोधन केअनुरूप,प्राधिकरणविशेष आर्थिकजोन अधिनियम, 2005की धारा 18(2) औरआईआरडीए अधिनियम,1999 की धारा 14 केसाथ पठितआईआरडीएआई (विशेषआर्थिक जोनमें बीमाव्यवसाय काविनियमन) नियम,2015 के नियम 3 केअंतर्गतप्रदत्तशक्तियों काप्रयोग करतेहुए इसकेद्वाराआईआरडीएआई(आईआईओ) दिशानिर्देश,2017 मेंनिम्नलिखितसंशोधन करता हैः

In line with the above amendment, the Authority inexercise of the powers conferred under Rule 3 of the IRDAI (Regulation ofInsurance Business in Special Economic Zone) Rules, 2015, read with Section18(2) of the Special Economic Zones Act, 2005 and Section 14 of IRDA Act, 1999hereby makes the following amendment to the IRDAI (IIO) Guidelines, 2017:

आईआरडीएआई(आईआईओ)दिशानिर्देश,2017 का खंड 8(ख)प्रतिस्थापितकिया जाएगा,अर्थात् :-

Clause 8 (b) of the IRDAI (IIO) Guidelines, 2017 shall besubstituted, namely: -

`ख.निवलस्वाधिकृतनिधि (एनओएफ) ‘b.Net Owned Fund (NOF):

i.             आवेदक,जो पुनर्बीमाव्यवसाय मेंलगी हुई एकविदेशी कंपनीहै तथा एकअंतरराष्ट्रीयवित्तीय सेवाकेन्द्र मेंएक शाखास्थापित करनेका प्रस्तावकरता है, केपास पंजीकरणके लिए आवेदनकरते समय बीमाअधिनियम, 1938 कीधारा 6 की उपधारा (3) मेंयथाविनिर्दिष्टनिवल स्वाधिकृतनिधियाँ(एनओएफ) भीहोंगी।

TheApplicant, which is a foreign company engaged in re-insurance business andproposes to establish a branch in an International Financial Services Centre,shall also have net owned funds (NOF) as specified in sub section (3) ofsection 6 of the Insurance Act, 1938 at the time of application forregistration.

ii.            ऐसीएनओएफ आवेदकके द्वाराअपने पंजीकरणकी अवस्थितिऔरविधिमान्यताके दौरान हरसमय अनुरक्षितकी जाएगी।

SuchNOF shall be maintained by the applicant at all times during the subsistenceand validity of its registration.

बशर्ते किआवेदक प्राधिकरणको आवेदक कंपनीकी शेयरधारिताके स्वरूप अथवास्वामित्व मेंपरिवर्तन, यदिकोई हो, के बारेमें ऐसापरिवर्तनलागू होने केतीस दिन केअंदर सूचितकरेगा।‘

Provided that the applicant shall inform the Authorityabout change in shareholding pattern or ownership of applicant company, if any,within thirty days of effecting such change.’

4.आईआरडीएआई(आईआईओ)दिशानिर्देश,2017 के सभी अन्यउपबंधअपरिवर्तितरहेंगे।

4. All other provisions of IRDAI (IIO) Guidelines, 2017 shallremain unaltered.

इसेसक्षमप्राधिकारीका अनुमोदनप्राप्त है।

This has approval of the Competent Authority.
